Job Description

The Commercial Lawyer will provide cross-functional advice to Orient Express and its affiliated companies, in order to guarantee the legal security of their activities and projects, minimize claims and avoid litigation.

The lawyer will work in an attractive and diverse environment, with a wide variety of internal and external interlocutors and a strong international dimension, with the aim of :

  • Securing projects (hotels, trains, vessels, etc.) by identifying legal issues, seeking the best solution and taking into account of the company's business objectives,
  • Drafting contracts in the areas of distribution law, consumer law, intellectual property law, marketing law, digital law, communications law, etc,
  • Advising teams by providing clear and relevant recommendations,
  • Anticipating and assessing legal and image risks and offering practical, appropriate solutions.

Reporting to the Legal Department, he/she will provide assistance to operational teams on a variety of issues relating to private business law.
In particular, the lawyer will be required to work in the following areas:


Commercial contracts:

  • Drafting and negotiating various contracts in French and English (confidentiality agreements, partnerships, letters of intent, hotel management contracts, franchises, general terms and conditions, IT contracts, referencing contracts, service contracts of all types, project monitoring, amendments to existing contracts, letters of formal notice, etc.).
  • Participation in updating our templates, training, drafting notes and guidelines for operational teams.

Intellectual Property

  • Participating in the strategy of defense and protection of our intellectual assets, prior searches, management of pre-litigation and litigation files in conjunction with our counsels (in particular preparation of cases, analysis, drafting of letters of formal notice, transactional protocols),
  • License agreements, assignments, acquisitions, coexistence agreements, contracts with our artists, designers, architects, etc,
  • Legal clearance of marketing and communication projects,
  • Legal monitoring and participation in the implementation of an anti-counterfeiting strategy.

Miscellaneous :

  • Advice and assistance on a variety of questions raised by operational staff in the field of private business law in the broad sense of the term.

The list of missions is not exhaustive and can be adapted according to the brand's priorities and projects. The lawyer will need to be flexible to work in new domains.
 


Qualifications

With a postgraduate legal qualification in business, contract and/or intellectual property law (Master 2, DJCE or CAPA), you will have at least 5 years' experience in a company/law firm (knowledge of the luxury and travel sectors would be a plus).
