We understand that the protection of personal data and privacy is part of the general expectations of candidates. For this reason, we have developed and implemented an up-to-date personal data protection charter (hereinafter the "Charter") which describes how personal data may be used within the scope of the candidate's use of the Accor recruitment platform (hereinafter "Platform"). The platform is managed by the company Accor SA, with its registered office at 82 Rue Henri Farman, 92130 Issy-les-Moulineaux, FRANCE. Accor SA is the parent company of the Accor Group. The company has chosen to implement the Platform for more effective and simplified management of recruitment procedures for (i) Accor Group entities (i.e., Accor SA and each of its subsidiaries, affiliated companies or entities controlled directly or indirectly) and (ii) other entities conducting their activities under the Accor Group brand (ie, entities that have entered into a franchise or management agreement with an Accor Group entity). This recruitment can be managed directly by the employee of the entity concerned. Accordingly, this Charter applies to candidates for employment in Accor Group entities or entities that have entered into franchise or management agreements, whether relating to external candidates or internally engaged employees. For the purposes of this Charter, all such persons shall be referred to indiscriminately as "Candidates". TAKE NOTE: Accor SA has determined the technical and functional characteristics of the Platform and ensures the maintenance of its operational conditions in the interests of the Accor Group. This company is thus considered a data controller. Each entity that uses the Platform to assist in recruitment activities (hereinafter referred to as the "Recruiting Entity") in turn becomes the data controller, to the extent that the entity itself determines and is responsible for the data collected and the way that data is used to carry out its recruitment activities under laws and regulations. appropriate locale. ACCEPTANCE OF CHARTER. Candidates should read the Charter carefully so that they are aware of the origin of the personal data that Accor SA and the Recruiting Entity hold about them and also how that data is used.
OBJECTIVES AND LEGAL BASIS. Accor SA, when not acting as a Recruiting Entity, processes the Candidate's personal data based on its legitimate interests which consists of (i) operating a platform to enable Accor Group entities and other entities operating under the Accor Group brand to more effectively manage their recruitment activities, ( ii) provide offers and issue notifications upon Candidate's request, (iii) manage and ensure follow-up of Candidate accounts, and (iv) generate statistics. Each Recruitment Entity processes Candidate's personal data based on its own legitimate interests, which consists of managing recruitment, selecting Candidate profiles that match the job vacancies, verifying their qualifications and ability to perform a job,
COLLECTED DATA. During the use of this Platform, certain fields are marked as mandatory. The field is a prerequisite for acceptance of the candidate's application. Applications will not be processed if the Candidate fails to submit the information. Candidates are free to determine whether they will provide the requested information in the fields marked as mandatory. However, relevant information may limit the Recruiting Entity's ability to consider applications during the hiring process. Depending on the specific nature of the relevant local laws and regulations, the Recruitment Entity may use the Platform to collect the necessary data to assess the Candidate's qualifications for the offered job. Such data may in particular concern: Candidate's contact and identity information: full name, gender, place and date of birth, nationality, contact information (address, personal telephone number, e-mail address), photo, and, more broadly, an identity element normally listed by the Candidate on the curriculum vitae; Candidate's education, training and career: training diplomas and certificates, previous professional experience, spoken foreign language, geographic mobility and, in general, all relevant information that Candidates normally provide in their curriculum vitae; Any additional information provided by the Candidate when submitting the application which can be specifically indicated in the curriculum vitae or cover letter; Depending on the recruitment procedures in each Recruiting Entity and the relevant local laws and regulations, information obtained from third parties: evaluation reports from recruitment agencies, verification of references regarding the professional environment or background checks, if necessary, as appropriate and legal. If Candidates use the mobile version of the Platform, Accor SA processes their geolocation data after obtaining approval to do so.
DATA STORAGE PERIOD. The Recruiting Entity retains the Candidate's personal data for the period necessary to fulfill the purposes contemplated in this Charter and in accordance with applicable laws. Under no circumstances will personal data in the Candidate account be retained for 3 months after the creation of the Candidate account. This period can be renewed for the same duration with the Candidate's approval.[RO1] Candidates can also deactivate their account at any time with the "Delete account" function. DATA RECIPIENT. Candidate personal data is intended for: qualified personnel at Accor SA who are responsible for the management and operational maintenance of the Platform and Candidate accounts; sub-contractors assigned by Accor SA to manage the Platform; qualified personnel involved in the hiring process at the Recruiting Entity who posted the offer; after acceptance of Candidate, Recruitment Entity may review Candidate files and invite Candidates if they have the same position to fill; external recipients involved in the recruitment process for the Recruiting Entity; local or foreign public authorities in the context of a formal request, for national security purposes or where required by law. In order to simplify the identification of Candidates on the Platform without the need to fill out registration forms or automatically fill in the data required for their applications, Accor SA proposes a system on the mobile version of the Platform to connect to social media and import data from these networks.
DATA TRANSFER OUTSIDE THE EU. For the purposes set out in this Charter, the Candidate's personal data may be transferred to possible entities in a country that provides a different level of personal data protection than that provided in Europe. Accor SA secures the transfer of personal data outside the European Union, on its initiative and if the transfer does not fall under any of the exceptions contemplated by applicable regulations, by implementing appropriate measures, i.e. standard European Commission type contract clauses or certification of recipients under the Privacy mechanism Shield if made in the US. Each Recruitment Entity is responsible for implementing the same measures with a view to securing data transfers outside the country in which it is incorporated, as origin, subject to local regulatory needs and requirements.
CANDIDATE RIGHTS REGARDING THEIR DATA. The candidate has the right to obtain information and access his/her personal data collected by Accor SA and the Recruitment Entity. The candidate also has the right to correct, delete or limit the processing of his data. The candidate also has the right to data portability and to issue instructions for processing the data after his death (referred to as "post-mortem" directives). Candidates may also object to the processing of their data. These rights can only be exercised if they do not impair performance in accordance with the contract or agreement between the Candidate and the Recruiting Entity. Accor SA reserves the right to deactivate or delete a Candidate's account in its sole discretion, immediately and without further formality, particularly in the case of: use of the Platform that fails to comply with current general conditions; unauthorized connections, especially fraudulent use of the Platform or identity theft; submission of more than fifty applications on the Platform by a single Candidate within a period of thirty days.
